We will not use your personal information for a materially incompatible purpose without providing any additional information or obtaining consent where required.
5. Who we share information with
Where necessary and proportionate, we may share personal information with:
- Shopify, which hosts and supports the online store;
- AutoDS, where used for product and order management;
- product suppliers and fulfilment warehouses involved in supplying an order;
- couriers and postal services;
- payment providers and banks;
- fraud-prevention and security providers;
- email, website, analytics and information-technology providers;
- accountants, legal advisers, insurers and other professional advisers;
- government bodies, courts, regulators or law-enforcement authorities where required or permitted by law; and
- a purchaser or successor if the business or relevant assets are transferred.
Suppliers and delivery partners should receive only the information reasonably needed for the relevant order or service.
We do not sell customers’ personal information for money.
The list of actual technology providers must be kept accurate. If a provider is removed or added, this policy and the cookie-preference information should be reviewed.
6. International processing
Some technology, payment, fulfilment, supplier or delivery providers may process personal information outside the United Kingdom.
Before transferring personal information internationally, we will rely on a lawful transfer mechanism where required, such as:
- UK adequacy regulations;
- the UK International Data Transfer Agreement;
- the UK Addendum to the EU Standard Contractual Clauses;
- an applicable approved certification or data-bridge arrangement; or
- another lawful mechanism under applicable data-protection law.
The actual countries and safeguards depend on the providers used by the store. The business will maintain a current transfer record identifying relevant providers, destinations and safeguards.
7. Cookies and similar technologies
The store may use cookies and similar technologies.
Strictly necessary technologies may be used to:
- operate the shopping basket;
- maintain checkout sessions;
- remember essential settings;
- prevent fraud;
- maintain security; and
- process orders.
Non-essential technologies may be used for:
- analytics;
- advertising;
- measuring campaign performance;
- personalisation; and
- remembering non-essential preferences.
Non-essential cookies and similar technologies will not be activated unless the required consent has been obtained. Continuing to browse the website will not, by itself, be treated as consent where consent is legally required.
The cookie-preference tool must provide a current list of relevant cookies or similar technologies, including, where applicable:
- provider;
- purpose;
- category;
- duration; and
- whether the technology is essential or optional.
You may change your cookie choices through the available consent controls or your browser settings. Disabling essential technologies may prevent parts of the store from working correctly.
8. Marketing communications
We may send marketing emails where:
- you have given consent; or
- the applicable law permits marketing to an existing customer in relation to similar products, and you were given a clear opportunity to opt out when your details were collected and in every subsequent message.
Every marketing email will include a straightforward unsubscribe method.
You can unsubscribe by:
- selecting the unsubscribe link in a marketing email; or
- emailing info.pawsandmoore@gmail.com.
Unsubscribing from marketing will not prevent us from sending necessary transactional messages about an order, delivery, return, refund or customer account.
9. Retention of information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, or for longer where required to comply with legal obligations or protect legal rights.
Our usual retention approach is:
- Order, payment and accounting records: generally up to six years after the relevant accounting or tax period, or longer where required by law or an unresolved dispute;
- Customer-account information: while the account remains active and for a reasonable period after closure;
- Customer-service, return and complaint records: generally for the period necessary to resolve the matter and, where relevant, to establish or defend legal claims;
- Marketing records: until consent is withdrawn or the individual opts out, except that a limited suppression record may be retained to ensure that the person is not contacted again;
- Security and fraud-prevention records: for the period reasonably necessary to protect the store and investigate suspected misuse; and
- Cookie and analytics information: for the periods stated in the live cookie-preference tool.
Information that is no longer required will be deleted, anonymised or securely restricted where reasonably possible.
10. Security
We use reasonable organisational and technical safeguards intended to protect personal information. These may include:
- secure ecommerce and payment systems;
- access controls;
- authentication and account-security measures;
- supplier and processor controls; and
- procedures for handling suspected data breaches.
No internet transmission or electronic storage system can be guaranteed to be completely secure.
11. Automated decision-making and profiling
We may use fraud-prevention tools to identify transactions or activity that require additional review.
We do not intend to make decisions producing legal or similarly significant effects about you solely by automated means. Where applicable law gives you rights concerning automated decision-making or profiling, we will provide the information and safeguards required by law.
12. Your UK data-protection rights
Depending on the circumstances, you may have the right to:
- be informed about how your personal information is used;
- request access to your personal information;
- request correction of inaccurate or incomplete information;
- request deletion of personal information;
- request restriction of processing;
- object to processing based on legitimate interests;
- object at any time to direct marketing;
- receive certain information in a portable format;
- withdraw consent where processing is based on consent; and
- complain to the Information Commissioner’s Office.
These rights are subject to legal conditions and exceptions. For example, information may need to be retained to comply with a legal obligation or establish or defend a legal claim.
To make a request, email info.pawsandmoore@gmail.com. We may ask for information reasonably necessary to verify your identity.
We will generally respond within one month of receiving a valid request, subject to any lawful extension or exception.
13. United States privacy rights
Residents of certain US states may have additional privacy rights where the relevant law applies to us and the particular processing activity.
These rights may include rights to request access, correction or deletion and to opt out of certain uses of personal information.
To submit a request, email info.pawsandmoore@gmail.com. We will not unlawfully discriminate against a customer for exercising an applicable privacy right.
14. Children
The store is intended for adults purchasing products for pets. We do not knowingly target children.
A person placing an order must provide accurate information and must have legal capacity to enter into the relevant purchase contract. Where consent is relied upon for an online service directed to a child, the applicable statutory age and parental-authorisation requirements will apply.
If you believe that a child has provided personal information unlawfully, please contact us so that we can investigate and take appropriate action.
15. Third-party websites
The store may contain links to websites controlled by third parties. Those organisations have their own privacy practices. We are not responsible for how unrelated third-party websites collect or use information.
16. Changes to this policy
We may update this policy to reflect changes to:
- the store;
- suppliers;
- fulfilment partners;
- technology;
- payment methods;
- marketing tools; or
- legal requirements.
The updated policy will be posted with a revised “Last updated” date. Where a change materially affects how personal information is used, we will provide any additional notice required by law.
17. Complaints
Please contact us first so that we can try to resolve your concern.
You may also complain to the Information Commissioner’s Office:
Information Commissioner’s Office
Wycliffe House
Water Lane
Wilmslow
Cheshire
SK9 5AF
A complaint may be made where you believe that your data-protection rights have been breached.
