TERMS OF SERVICE

These Terms of Service apply to the use of www.pawsandmoore.uk and purchases made through the store.
1. About Paws & Moore

“Moore Group” is an additional trading name used for banking and administration and is not a separate legal entity.
References to “Paws & Moore”, “we”, “us” and “our” mean Lewis Moore trading as Paws & Moore.
2. Acceptance of these terms
These terms, together with the product information, delivery information and Return and Refund Policy displayed before checkout, form the basis on which we supply products.
Before submitting an order, you will be given an opportunity to review and correct your order. Nothing in these terms excludes or restricts rights that cannot lawfully be excluded, including mandatory consumer rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, SI 2013/3134.
A link to these terms should be available at checkout and the applicable contractual information should be confirmed to the customer on a durable medium, such as email.
3. Customer eligibility
You must provide complete and accurate information when ordering.
The store is intended primarily for adults. If you are under 18, you should place an order only with the involvement and permission of a parent or legal guardian.
Nothing in this section removes any statutory rights that may apply to a minor or prevents a parent or guardian from exercising rights on behalf of a child where legally permitted.
4. Product information
We take reasonable steps to describe and display products accurately.
The following may vary without necessarily meaning that the goods fail to conform to the contract:
- colours caused by screen settings;
- measurements stated as approximate;
- packaging that does not affect the product’s function or characteristics; and
- minor design details that do not materially alter the product.
A manufacturer or supplier change that materially alters the product’s description, characteristics, purpose or functionality will not be imposed on you without your agreement. If an accepted order cannot be supplied as described, we will offer an appropriate remedy, which may include cancellation and a refund.
5. Pet safety
You are responsible for choosing products appropriate for your pet’s:
- species;
- breed;
- size;
- age;
- health;
- behaviour; and
- individual needs.
Follow all product warnings and instructions.
Pet toys and accessories are not indestructible. Pets should be supervised where appropriate, and damaged products should be removed immediately.
Product descriptions and website content do not replace professional veterinary advice. Contact a qualified veterinary professional if you are uncertain whether a product is suitable for your pet.
This section does not exclude liability for defective or unsafe products or for loss caused by our breach of a legal duty.
6. Prices and charges
Prices and charges payable by UK customers will be displayed clearly before an order is submitted.
The displayed total will identify, where applicable:
- the product price;
- applicable VAT or other taxes;
- delivery charges;
- customs or import charges known to us; and
- any other mandatory charge payable through the store.
We may change prices before an order is accepted. A price change will not affect an order after the contract has been formed, except where the order is cancelled in accordance with these terms or applicable law.
7. Payment
Payment must be made using one of the methods displayed at checkout.
Payment processing may be provided by Shopify or another payment provider.
The payment description shown on a bank or card statement may refer to Paws & Moore, Lewis Moore, Shopify or the relevant payment provider. We will take reasonable steps to ensure that the descriptor is not misleading.
8. Obvious pricing and technical errors
We take reasonable care to avoid pricing, description and technical errors.
If an obvious and material error is identified before the contract is formed, we may contact you and invite you to proceed using the corrected information or cancel the order.
If an obvious and material error is identified after the contract has formed, we may cancel only where the law and the contract permit cancellation and where it would be fair and reasonable to do so. If we cancel after payment has been taken, we will refund the affected amount without undue delay.
We will not intentionally rely on an obvious error to mislead a customer.
9. Placing an order and contract formation
Submitting an order is an offer to purchase the selected products.
An automated order acknowledgement confirms that we received your order. It does not necessarily mean that the order has been accepted.
The contract is normally formed when we expressly confirm acceptance or dispatch the goods, whichever occurs first, unless the checkout process clearly states another method of acceptance.
We may reject an order before the contract is formed where:
- payment is not authorised;
- a product is unavailable;
- the delivery address cannot be served;
- there is an obvious and material error;
- fraud or misuse is reasonably suspected;
- purchase limits have been exceeded; or
- completing the order would be unlawful.
If the contract has already formed, we will not treat this section as giving us an unrestricted right to cancel.
10. Product availability
Products are subject to availability.
Stock information may be supplied by third-party suppliers and can occasionally change before an order is processed.
Where a product becomes unavailable before the contract is formed, we may reject the order.
Where a product becomes unavailable after the contract has formed, we will contact you and provide the remedy required by law. This may include offering an alternative only with your agreement or cancelling the affected product and providing a refund.
11. Third-party fulfilment
Products may be stored, packed and dispatched by third-party suppliers or fulfilment partners.
AutoDS may assist with transmitting order information and managing fulfilment.
Paws & Moore remains the retailer and the customer’s point of contact for purchases made through the store. The use of a supplier, warehouse, courier or technology provider does not remove our responsibility for the contract with the customer.
12. Delivery
We currently deliver to eligible addresses in:
- the United Kingdom; and
- the United States.
Processing periods, delivery estimates and other delivery information are contained in our Shipping Policy.
Orders containing multiple products may arrive in separate packages or on different dates.
For UK orders, goods will be delivered without undue delay and, unless a different period has been clearly agreed, no later than 30 days after the contract is formed.
Delivery estimates do not remove statutory rights relating to late or non-delivery.
13. Customs, duties and import charges
Orders delivered internationally may be subject to:
- customs procedures;
- import duties;
- sales taxes; or
- carrier handling charges.
Where such charges are not collected at checkout, we will identify that fact before the order is submitted where required. Customers should not be required to pay charges that we were legally required to include in the advertised or checkout price.
Customers are responsible for checking whether a product may lawfully be imported into their destination country. This does not remove any responsibility imposed on us by applicable consumer, product-safety, tax or customs law.
14. Cancellation, returns and refunds
Cancellation, return and refund arrangements are explained in our Return and Refund Policy.
Nothing in that policy or these terms limits mandatory statutory rights, including:
- the right to cancel qualifying distance contracts;
- the short-term right to reject non-conforming goods;
- repair or replacement rights;
- price-reduction or final-rejection rights; and
- rights relating to late or non-delivery.
15. Promotions and discounts
Promotional offers may be subject to additional conditions displayed with the offer.
Unless stated otherwise:
- only one discount code may be used per order;
- discounts cannot be exchanged for cash;
- codes may expire;
- selected products may be excluded;
- minimum spending requirements may apply; and
- delivery charges may be excluded.
Promotional claims will not be presented in a way that is misleading about the reference price, availability, duration or terms of the offer.
16. Reviews and customer content
Where you submit a review, photograph or other content, you confirm that:
- it reflects your genuine experience;
- you have the right to submit it;
- it does not infringe another person’s rights;
- it is not unlawful or abusive; and
- it is not deliberately misleading.
We may moderate or remove content for lawful and genuine reasons, including fraud, unlawful content, abuse, privacy violations or failure to comply with the review rules. We will not remove or suppress a genuine review merely because it is negative.
We will not knowingly publish fabricated reviews, manipulate reviews, or present incentivised reviews as unincentivised. Any material connection or incentive will be disclosed where required.
17. Acceptable website use
You must not:
- use the website unlawfully or fraudulently;
- interfere with its security or operation;
- introduce malicious software;
- attempt unauthorised access;
- scrape or copy protected content without permission;
- impersonate another person;
- submit false payment or delivery information; or
- use the website in a way that harms other users or the business.
We may suspend access where reasonably necessary to protect the website, customers or business, but this does not affect rights under an existing purchase contract.
18. Intellectual property
Unless stated otherwise, the Paws & Moore name, logo, original text, graphics and website materials are owned by or licensed to Lewis Moore.
You may use the website for personal shopping purposes.
You may not reproduce, sell, modify or commercially exploit protected materials without permission, except where permitted by law.
19. Third-party services
The website may use services operated by third parties, including:
- Shopify;
- AutoDS;
- payment providers;
- suppliers;
- couriers; and
- analytics or marketing services.
Third-party websites and unrelated services may be governed by their own terms and privacy policies. This does not make those providers parties to the sales contract between you and Paws & Moore.
20. Our responsibility
We are responsible for losses that are a foreseeable result of our breach of these terms, our failure to use reasonable care and skill, or our breach of a legal duty.
Nothing in these terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- defective products where liability cannot lawfully be excluded;
- breach of statutory consumer rights; or
- any other liability that cannot lawfully be excluded or limited.
If you purchase entirely for personal purposes, we are not responsible for losses that are exclusively business losses, such as loss of profit, revenue or commercial opportunity, unless applicable law provides otherwise.
21. Events outside reasonable control
We are not responsible for delay caused by an event outside our reasonable control, provided that we take reasonable steps to minimise disruption and communicate with affected customers where appropriate.
This section does not remove rights relating to:
- cancellation;
- refunds;
- seriously delayed delivery;
- non-delivery;
- damaged goods; or
- goods that do not conform to the contract.
22. Changes to these terms
We may update these terms to reflect changes to the store, services or legal obligations.
The version in force when an order was placed will normally apply to that order. A later change will not retrospectively remove rights arising under an earlier contract.
23. Governing law and jurisdiction
These terms are governed by the law of England and Wales.
If you are a consumer, you may also benefit from mandatory protections under the law applying where you live. Nothing in these terms removes those protections.
Where permitted by law, the courts of England and Wales will have jurisdiction. A consumer may also be entitled to bring proceedings in the courts of the part of the United Kingdom or other jurisdiction in which the consumer lives.
